Measures for the Administration of the Qualification Certificate of Coal Mines in Yunnan Province (Part Two)

Article 9 The following materials shall be submitted for the change of the qualification certificate of the mine manager:

(1) Application form for the change of the qualification certificate of the mine manager (in triplicate, see Annex 2);

(B) the coal production license office of coal mine (mine mining infrastructure provided by the license) copies;

(3) The proposed certificate of employment issued by the newly appointed unit;

(4) A copy of the ID card and 3 photos of the recently-discarded two-inch photo;

(5) The original certificate of the original mine qualification certificate.

Article 10 The following materials shall be submitted for the loss of the qualification certificate of the mine manager:

(1) Application form for the certificate of the qualification certificate of the mine manager (in triplicate, see Annex 3);

(2) A written loss statement of the public media;

(3) A copy of the ID card and 3 photos of the recently-free two-inch photo.

Article 11 Units applying for the qualification certificate of the mine may obtain the application form from the local competent coal authority or the provincial prison administration or the provincial state-owned coal enterprise group, or directly on the “Industry and Information Technology Committee” portal ( ) download. The application materials for the mine qualification certificate shall be reported to the Provincial Industry and Information Technology Committee after being verified by the competent coal department or the provincial prison administration and the provincial state-owned coal enterprise group.

Article 12: Application materials receipt, acceptance

(1) The county (city, district) coal competent department shall complete the verification of the application materials within 5 working days. If the information is incomplete or does not meet the relevant conditions, the applicant should be notified at one time.

(2) The state (city) coal competent department shall complete the review of the written materials submitted by the county (city, district) coal authorities within 5 working days. If the information is incomplete or does not meet the conditions, the applicant shall be notified at one time.

(3) The Provincial Prison Administration and the provincial state-owned coal mining enterprise group shall report to the Provincial Industry and Information Technology Committee after reviewing the application materials of the subordinate units. If the information is incomplete or does not meet the requirements, the Provincial Industry and Information Technology Commission shall notify the applicant at one time within 5 working days.

Article 13 The Provincial Industry and Information Technology Commission shall review the application materials submitted by the state (city) and provincial prison administrations and the provincial state-owned coal mining enterprise groups and make decisions on certification, modification and re-certification. The decision shall be made within 10 working days from the date of receipt of the material; if the condition is not met, the reason shall be explained. If it cannot be settled within the prescribed time due to special circumstances, it may be extended by 10 working days with the approval of the person in charge of the administrative organ, and the applicant shall be informed of the reasons for the extension.

Article 14 The qualification certificate of the mine manager shall be examined once every two years. The mine manager shall participate in the examination and examination within 2 years after the initial training completion.

Article 15 The following documents shall be submitted for the review of the qualification certificate of the mine manager:

(1) Checklist for the qualification certificate of the mine manager (in triplicate, see Annex 7);

(2) A copy of the qualification certificate of the mine re-examination examination;

(3) A copy of the mining certificate of the unit of employment;

(4) A copy of the ID card and 3 photos of the recently-free two-inch photo. ;

Article 16 If the mine manager has one of the following circumstances, it shall be unqualified for inspection.

(1) The coal mines in the coal mines that have been employed for more than two inspections within one month found that their operators did not carry out skills safety education and training or that special operations personnel were undocumented;

(2) In the daily management and various construction processes of the coal mines in which they are employed, there are acts of fraud;

(3) failing to participate in the re-examination or re-training of the mine manager in accordance with the regulations;

(4) There are potential safety hazards in the coal mines in which they are employed, and they are not allowed to organize production without complying with the requirements after rectification or rectification;

(5) The coal mines that were employed were suspended for rectification and bad records for more than three times within two years.

Article 17 Those who fail to pass the examination shall participate in the re-training and examination organized by the Provincial Industry and Information Technology Committee within 2 months.

Article 18 The coal industry management departments at all levels, the provincial prison administration bureau and the provincial state-owned coal enterprise groups shall supervise and manage the mine managers under their jurisdiction.

Article 19 The issuing authority shall be responsible for the coal mine or mine that has been ordered to suspend production for rectification.

If the company is suspended from investigation, it shall temporarily detain its qualification certificate.

Article 20 If a coal mine has been found to have major production hazards in 2 or more times within 3 months, and the production is still in progress, the certification authority will revoke its qualification certificate.

Article 21 The Provincial Industry and Information Technology Commission is responsible for publicizing the following contents to the public on the government affairs open website ():

(1) The qualification certificate of the mine manager who issues, changes, reissues or revokes;

(2) The results of the examination and approval of the qualification certificate of the mine manager;

(3) Annual plan for mine training and recurrent training.

Article 22 These Measures shall come into force on March 11, 2010. The relevant provisions imposed before this are inconsistent with these Measures.
